Terms and Conditions of Sale

This document establishes the pre-contractual information relating to contracts concluded at a distance, through the address www.adegacartaxo.pt referred to in article 4 of Decree-Law No. 24/2014 of 14 February, and of all sub domains, digital applications or sub-websites. The registered trademark Adega do Cartaxo and respective domain www.adegacartaxo.pt is owned by Adega Cooperativa do Cartaxo, Crl, with headquarters at Sítio da Precateira, natural person with Tax Nº 500008353, hereinafter referred to as "Adega do Cartaxo".

Adega do Cartaxo reserves the right to freely modify this pre-contractual information in order to adapt it to the applicable legislation, without the need for any prior notice, advising users to check it frequently.
Both browsing and purchase through the website and / or digital applications, presupposes the acceptance of the present information and practices described in this document and the Exchanges and Returns document. The online sale is valid and applicable to mainland Portugal.

Adega do Cartaxo offers a Customer Support service, through which the Customer can, at any time, contact Adega do Cartaxo to ask for clarifications, make suggestions or submit complaints, through the email address loja@adegacartaxo.pt or through the Customer Support line 243 770 987 (call to the international fixed network), available at weekdays from 9:00 am to 1:00 pm and from 2:30 pm to 6:30 pm (local call rate).

INTRODUCTION
Sales made through the online store www.adegacartaxo.com presuppose the Customer's acceptance of the General Sales Conditions that are established in compliance with the legislation applicable to the electronic commerce sector in general.

Adega do Cartaxo is not responsible for any facts resulting from the unavailability of the website, for however long, and also reserves the right to restrict access to some areas of the website for technical reasons or for compliance with legal obligations.


THE SITE'S CONDITIONS OF USE
The Customer must be at least 18 (eighteen) years old to create an online account and make purchases on the website www.adegacartaxo.com, under the commitment that all information related to their identification and other data necessary for the carrying out and processing of the respective order are true, updated and complete. The Customer must use the website www.adegacartaxo.com in compliance with the provisions of the applicable legislation.


PRODUCT INFORMATION
Adega do Cartaxo will bear the responsibility for the information provided directly by us regarding the products sold. The information made available on the website does not dispense with consulting the product labels upon receipt and before their use. If the Customer has any questions or if they  want more information about the products, they must contact one of the contact channels belonging to the Customer Support service.

Adega do Cartaxo reserves the right to modify the commercial information presented about products at any time.

Every effort has been made to ensure that the information presented in our online store is free of typographical errors and whenever these occur, Adega do Cartaxo will proceed with the respective correction as soon as possible. The photographs of the products available in the online store are as reliable as possible, in order to reproduce the product (s) as it really is.
    
The catalogue of articles sold in the online store www.adegacartaxo.pt is independent of the physical store (s), both in terms of price and quantities in stock.

All promotional campaigns have limited and exclusive stock for online sale.

The browsing and consultation of information published in the online store www.adegacartaxo.pt, by the users, is totally free, and is not linked to any mutual commercial or professional relationship.

PRICES AND PAYMENT

The prices of the products in the online store are those stipulated, at all times (except for typographical errors), which include the applicable VAT rate, according to the legislation in force at the time of purchase, and the shipping costs for Continental Portugal.

The total amount payable for the order covers the sum of the value of the product (s) with the applied VAT rate and delivery fee.

Adega do Cartaxo undertakes to make all the necessary efforts to minimize errors in the price list of the products, however,  in the event of incorrect pricing of the product (s) ordered, Adega do Cartaxo will inform the customer as soon as possible, leaving the decision on the cancellation or readjustment in the total of the respective purchase at the discretion of the customer, if the price is higher. If the price of the product is lower than the advertised price, Adega do Cartaxo will refund the difference.

If it is impossible to contact the customer, Adega do Cartaxo reserves the right to cancel the order, the customer being refunded in full the amount paid, with no compensation whatsoever for the cancellation.

Adega do Cartaxo denies any obligation to supply products whose price is incorrect, due to an obvious and unequivocal error, even if the Shipping Confirmation has been carried out.

Except for the clauses previously established herein, the price (s) of the product (s) may be changed at any time, without the need for prior notice and, without the changes affecting the orders for which Adega do Cartaxo has already sent an Order Confirmation.

In case of suspected fraud in the payment process, Adega do Cartaxo reserves the right to postpone the order, until the suspicion is clarified.


PRODUCT AVAILABILITY
The sale of the product (s) online does not effectively guarantee the existence of real-time stock available at the time of purchase. We inform that some items available in the online store are subject to order, whose delivery times are estimated, and so, therefore,  Adega do Cartaxo cannot be held responsible for delays that may occur in orders.



PURCHASES AND PAYMENTS
The order and purchase process is only possible after the creation of a Customer account and / or the Customer's login to the online store, which must follow the various sequential steps of the order process that will allow the registration of the purchase.
In order to optimize security, all purchase transactions take place under strict confidentiality and encryption in accordance with the SSL protocol.

Adega do Cartaxo offers the following payment methods for purchases made in the online store:
• Payshop
• MB Way
• ATM references


SHIPPING AND DELIVERY
Whenever the necessary conditions are not met for the delivery of the products in a single shipment, whether due to a delay or momentary unavailability of part of the order, Adega do Cartaxo will make a phased delivery, the customer being informed in advance by email.
The shipment of the product (s) whose stock allows for immediate delivery, will be made within 48 hours, with delivery scheduled for Mainland Portugal in 2-4 working days.

Without prejudice to the provisions of the previous clause, regarding the availability of the product (s) and, unless there are extraordinary circumstances, orders will be shipped within the date specified in the Shipping Confirmation provided by Adega do Cartaxo in the purchase process. If, for any reason, it is not possible to meet the delivery date, the Customer will be informed, by telephone or electronic contact, of this circumstance, establishing a new date. Any delay in the shipment of the product (s), given the estimated dates presented, does not entitle the customer to any compensation.

Adega do Cartaxo only dispatches orders on business days. Therefore, neither weekends nor public holidays are counted for the estimated delivery of orders.


Adega do Cartaxo does not deliver to PO boxes.

Upon delivery, the Customer must verify that the packaging is in perfect condition. In case of damage, visible defect or error in the requested product, you should refuse orders from the carrier's courier, filling out the form for these cases, indicating the problem found.

For the purposes of these conditions, it will be understood that the "delivery" has taken place or that the order has been delivered, upon signature by the responsible person present at the agreed address.


IMPOSSIBILITY OF DELIVERY
The delivery of the product (s) will be made to the address indicated at the time of purchase. In the event that the delivery does not take place, given the absence of someone responsible for receiving it, due to the characteristics of the place of delivery or due to the volume and weight of the order, the carrier will proceed with a warning note or will contact you to arrange the day and time of the new delivery.

If delivery is not possible on the agreed date or address in advance, the Customer must communicate this to Adega do Cartaxo, as soon as possible, in order to establish a new delivery agreement.

In the event that the order returns to Adega do Cartaxo, for reasons that did not allow for its delivery - absence at the address, lack of pickup, insufficient / incorrect address or other errors that occur - Adega do Cartaxo will not be responsible for the costs of reshipment. The fees and costs of resending the product (s) are applied to the customer, in the second attempt at shipping / delivery.


EXCHANGES AND RETURNS
Adega do Cartaxo does not accept exchanges and product returns after the order the order is received.


SUGGESTIONS AND COMPLAINTS
The opinion of Customers is very important for Adega do Cartaxo as it allows the implementation of improvements in the products and services provided. Thus, if for any reason the Customer is not satisfied, Adega do Cartaxo would like to be informed of any situation, within 7 days of receiving the order by the recipient, to one of the Customer Services contact channels.

If the Customer has received a non-compliant product, they must attach a video or photographs to their complaint, as the case may be, in which the problem detected is clearly visible.

The Customer must also keep in their possession, until otherwise indicated by Customer Services, defective, damaged or non-compliant product and its respective packaging.

Depending on the outcome of the evaluation of the complaint, if the complaint is accepted, the Customer may be reimbursed for the value of the product purchased by bank transfer or by sending a new product, according to the agreement established between Adega do Cartaxo and the Customer.



INTELLECTUAL PROPERTY
The reproduction of any documents published in the online store is authorized for information purposes only, for strictly personal and private use. Any reproduction or representation, in whole or in part, of the website or any of its elements, in any medium whatsoever, and in any form whatsoever, for other purposes, namely commercial, is expressly prohibited.



NON-PERSONAL DATA
All information, communications and other material data, sent through our online store, electronic contact or direct delivery to the Adega do Cartaxo address, which do not constitute identification of the natural person, will be considered non-confidential data, exempt from the protection covered in the policy of privacy and data protection.

Adega do Cartaxo reserves the right and freedom to use or reproduce ideas, concepts, know-how or techniques contained in the information sent, regardless of the purpose, including the development, manufacture or sale of new products.
Legal action will be taken by competent legal means against whomsoever acts to the contrary,  the information and content sent by the Customers must respect the total legality, above all, under the terms of Copyright.


EXCLUSION OF WARRANTIES AND LIABILITY
The user recognizes and accepts that the use of the website is their sole and exclusive responsibility.

Adega do Cartaxo does not, in general, control the use that users make of the website and, in particular, does not guarantee that users use the website in accordance with the Law, the present conditions of use, morals and good customs in general accepted in public order, nor if do they do so diligently and prudently.

The website and all the materials offered on it are intended only for the purpose of general information for the Customer.

Adega do Cartaxo is not responsible for damages resulting from any computer viruses, network or internet supply problems, or any other situations to which it is alien and which prevent the access and correct functioning of the www.adegacartaxo.pt domain, as well as services available on it.

Adega do Cartaxo may, at any time and without prior notice, change the presentation and lay out of the website, as well as the present conditions or, if necessary, introduce new conditions of use through their respective publication on the website, in order to make them known to the user the moment they accesses it and before proceeding to use it.
The use of the website, once the applicable changes are made, will mean the user's acceptance of the modified conditions.


GOVERNMENT LAW AND JURISDICTION
In Portugal, Portuguese Laws apply, the parties being subject to the exclusive jurisdiction of the Portuguese Courts.
